The learned counsel for the Petitioner submits that though the Petitioner is the Co-operative Bank not assisted financially by the State nor the State has direct or indirect N.S. Kamble page 1 of 3
control over it, and though an objection was raised before the First Appellate Authority under Right to Information Act with regard to the locus standi of the Respondent to file an Application, without hearing the Petitioner order came to be passed rejecting the Appeal directing providing of the information. To support his submission he has placed reliance on the decision in the case of Dr.Panjabrao Deshmukh Urban Co.Operative Bank V/s. State Information Commissioner and Others1 3.
Prima facie the Petitioner has made out an arguable case, hence, issue notice to the Respondents, returnable on 4th October 2024.

In Writ Petition No.12063 of 2024 the Appeal has been allowed filed by Respondent whereas in Writ Petition No.12064 of 2024 the Appeal filed by the Petitioner has been dismissed. In the aforesaid discussion both orders deserve to be stayed till next date of the hearing. Hence, both orders are stayed till next date of the hearing.
