IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.12071 OF 2024 Prof. Laxman Shivaji Godse ....Petitioner V/S All India Shri Shivaji Memorial Society & Anr. ....Respondents _________ Mr. Yashodeep Deshmukh a/w Ms. Vaidehi P. Deshmukh for the Petitioner.

Mr. Shantanu Patil h/f Mr. Shrikrishna Ganbavale for Respondents-Management.

__________ CORAM: SANDEEP V. MARNE, J.

DATE : 21 APRIL 2025.

P.C.:

1.

According to Mr. Deshmukh, the learned counsel appearing for the Petitioner, the short issue that arises for consideration in the present Petition is whether the service record of the Petitioner for consideration of his case under Career Advancement Scheme (CAS) for the years 1998 to 2003 is relevant or whether service record for the period 2004 to 2008 could have been considered?

2.

According to him, though the selection committee met in the year 2009, entitlement of the Petitioner for CAS as in the year 2004 was under consideration and that therefore his service record prior to the year 2004 alone was relevant for deciding his CAS entitlement.
