The learned counsel for the petitioner, on instructions, seeks leave to withdraw the present petition with liberty to file a fresh application before the Family Court for custody of the childVivaan. 2.

If such application is filed, the Family Court shall grant opportunity to the respondent to file reply, if any. The Family Court shall permit the parties to lead evidence.

The petition is disposed of as withdrawn with liberty as sought.
