IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 12227 OF 2024 Mrs. Gurpreet Chhabra & Anr.
...Petitioners
Vs.
The Ministry of External Affairs & Ors.
...Respondents
_______ Mr. Zeeshan Siddique a/w. Zubi Ansari for the petitioner. _______
CORAM:
G. S. KULKARNI & ADVAIT M. SETHNA, JJ.
DATED:
26 March, 2025 P.C.
1.
We are not at all satisfied with the reliefs as prayed for in the petition. This petition has been filed by petitioner no. 1, who is stated to be mother of petitioner no. 2, a minor.
2.
The concern of petitioner no. 1 is in regard to the renewal of passport of petitioner no. 2, which is issued by the Government of United States of America. The renewal of passport accordingly is to be undertaken by respondent no. 4- The United States Consulate. In our clear opinion, we would not have jurisdiction to issue any writ of this Court to the U.S. Consulate. If petitioner no. 2 is the U.S. citizen, it is for the U.S. Consulate to be concerned about its citizen even on the foreign territory.
3.
We are informed that the custody of petitioner no. 2 is with the motherpetitioner no. 1 and if this be so, it is for the mother to pursue the passport renewal application before the U.S. Consulate. 4.
Thus, keeping open all contentions of the petitioner, we dispose of this petition to enable petitioner no. 1 to resort to the appropriate course of action. 5.
Disposed of in the above terms. No costs.
