Since an alternate remedy of approaching the Debts Recovery Appellate Tribunal is available to the petitioner, we are not inclined to entertain the writ petition. The petitioner is free to invoke the alternate remedy.

On instructions, the learned counsel appearing for respondent no.1 submits that for a period of one week from today, no steps would be taken to sell the secured assets.

Considering the fact that there will be holidays from 14th September 2024 to 17th September 2024, it is directed that for a period of two weeks from today, such steps may not be taken by the respondent no.1 to enable the petitioner to avail the alternate remedy. It is clarified that all points on merits of either sides are kept open.
