The learned Assistant Government Pleader on instructions submits that when possession of the secured asset was to be taken on 4th December 2024, the borrower had tendered a cheque for an amount of Rs. 4,00,000/- in favour of the petitioner. For that reason, possession was not taken on that date. He further submits that this cheque however was not honoured . 2.

In view of aforesaid, it is directed that within a period of four weeks of receiving copy of this order, the respondents shall take necessary steps to deliver possession of the secured asset to the petitioner. In case necessary charges are paid, police protection shall also be provided as per rules.
