By order dated 4th September 2024, the above Writ Petition was disposed of by accepting a statement made on behalf of Respondent No.1 that the Appellate Authority of Respondent No.1 shall hear the Appeal filed by the Petitioner, and take a decision on the said Appeal and communicate the same to the Petitioner on or before 9th October 2024. 2.
Since these directions were not complied with, on 24th October 2024, we recorded the apology of Respondent No.1 for the delay and also a NOVEMBER 11, 2024 Aswale
2.wp.12378.24.doc statement that by 11th November 2024, the order in the Appeal filed by the Petitioner shall not only be passed but also communicated to the Petitioner. We had, therefore, kept the matter for reporting compliance today. 3.
Today when the matter is called out, we are informed that the Appellate Authority of Respondent No.1 has decided the Appeal filed by the Petitioner vide its order dated 8th November 2024. We are also informed that the Appellate Authority has decided the issues against the Petitioner. 4.
Considering these circumstances, we find that the directions given by us on 4th September 2024 and 24th October 2024 are now duly complied with. Hence no further orders are now necessary. If the Petitioner is aggrieved by the decision taken by the Appellate Authority of Respondent No.1, it is free to take such actions as it may be entitled to in law. All contentions in that regard are kept open.
