The submission raised by learned Counsel appearing for the Respondent is that Mutation Entry No. 668 was disputed by the Petitioner in the year 1966 and was confirmed by an order of the Mamlatdar which has not been challenged till date. He points out the finding of the Tahsildar which considers that in the earlier round of litigation Mutation Entry No. 668 was confirmed which has not been challenged. While recording the said finding it has been recorded that the property was standing in the name of M/s. F. E. Dinshaw Trust who had thereafter in those proceedings submitted that they are not the owners of the property.

Considering the said submissions it would be appropriate Shubham Talle 1 of

21-WP-12494-2024.doc to call for an affidavit-in-reply to be placed on record within a period of 2 weeks from today. Rejoinder, if any, be filed within 1 week thereafter. 3.

List the matter on 9th December, 2024.
