Feeling aggrieved by the order dated 07.10.2024, passed by the learned Presiding Officer, Land Acquisition Rehabilitation and resettlement authority, Aurangabad in Claim No.2023/LARRA-A/AUR/AUR/2565, the petitioner has filed present petition.

Mr. V. D. Sapkal, Sr. Counsel a/w Ms. S. P. Patil, i/b Mr. S. R. Sapkal, learned Counsel for the petitioner who was also a stake holder to the compensation had objection as regards to partial compromise that took place before the authority. He would submit that any compromise must be a full and final settlement and must be executed before the Civil Court. Mr. Sapkal, learned Senior Counsel submits that during pendency of this petition, the compromise between all the parties to the litigation and all the stake holders in the subject

21-wp-12552-2024 matter/compensation has taken place in Special Civil Suit No.333 of 2014 pending in the Court of learned Civil Judge Senior Division, Aurangabad.

Copy of the compromise decree is placed on record and marked as 'X' for identification.

Mr. Sapkal, learned Senior Counsel as also Mr. S. S. Khoche, learned Counsel for respondents submit that the parties have settled the controversy and the impugned order dated 07.10.2024 be quashed and set aside. They further submit that the Presiding Officer, Land Acquisition Rehabilitation and Resettlement Authority, Aurangabad to act upon the compromise decree dated 13.01.2026 in the Special Civil Suit No.333 of 2014.

In view of this, the impugned order dated 07.10.2024, passed by the Presiding Officer, Land Acquisition Rehabilitation and Resettlement Authority, Aurangabad is quashed and set aside.

The Presiding Officer, Land Acquisition Rehabilitation and Resettlement Authority, Aurangabad to process the apportionment of the compensation amongst the stake holders on the basis of the compromise decree in Special Civil Suit No.333 of 2014.

Writ Petition is disposed of accordingly.
