Learned counsel for the Respondent Nos. 1 and 2 raises preliminary objection to the maintainability of the Petition as under Section 51(2) of the Maharashtra Public Trusts Act, 1950 an Appeal lies against the order of rejection of application seeking consent for institution of the Suit.

In view thereof, learned counsel for the Petitioners seek permission to withdraw the petition with liberty to adopt appropriate proceedings. The petition is disposed of as withdrawn. 3.

It is open for the Petitioners to adopt appropriate proceedings, if permissible in law. All rights and contentions of both the parties in that respect are expressly kept open.
