Heard the learned Counsel for the parties.

The learned Counsel for the parties submit that, the parties have arrived at an amicable resolution of the dispute and minutes of the order have been drawn.

The learned Counsel for the parties seeks leave to tender by SANTOSH SUBHASH KULKARNI Date: 2026.01.17 10:52:09 +0530 SANTOSH SUBHASH KULKARNI minutes of the order.

Leave granted.

The minutes of the order are taken on record and marked 'X' which read as under:-.

"1. Petitioner has filed the present petition challenging order dated 21st June, 2023 rejecting their application for return of plaint in Summary Suit No. 13/2021 pending before the Court of Senior Division, Civil Judge at Palghar, Maharashtra. After arguing the matter for some time, both sides agree that Summary Suit No. 13 of 2021 pending before Civil Judge, Senior Division, Palghar can be transferred to the City Civil Court at Dindoshi, Mumbai."

In view of the aforesaid minutes of the order, the Summary Suit No. 13/2021, pending on the file of learned Civil Judge, Senior Division, Palghar stands transferred to the City Civil Court at Dindoshi for hearing and disposal in accordance with law.

The ad-interim relief granted by this Court by order dated 25th July, 2024 stands vacated.

The learned Civil Judge, Senior Division, Palghar is requested to transfer the record and proceeding in Summary Suit No. 13/2021 to the City Civil Court at Dindoshi, Mumbai with such dispatch that, it reaches the City Civil Court within a 2/3

period of four weeks from the date of communication of this order.

The suit stands transferred to the City Civil court at Dindoshi without prejudice to the rights and contentions of the parties on the merits of the matter. However, the parties shall not be entitled to again agitate the point of jurisdictional competence of City Civil Court at Dindoshi to entertain, try and decide the transferred suit (Summary Suit No. 13/2021). 10.

Upon transfer, the learned Judge, City Civil Court, Dindoshi, is requested to hear and decide the suit as expeditiously as possible.

The petition thus stands disposed.
