The name of the Petitioner was pronounced in the open court. Mr. Kamleshkumar Sarode came forward and stated that he is appearing in person.

The Petitioner was before the Labour Court in Reference (IDA) No.136 of 1998. By the award dated 28th April, 2011 the reference was partly allowed. He was granted reinstatement in service with continuity, without backwages.

The Petitioner/workman approached the Learned Single Judge in Writ Nikita

1-wp-12614-2024.odt Petition No.4975 of 2016 under Article 227 of the Constitution of India, praying for 100% backwages. By judgment dated 25th July, 2024 the learned Single Judge of this Court concluded that there was no error in the award of the Labour Court denying backwages to the Petitioner. The Writ Petition was dismissed. It is against the said judgment of the learned Single Judge that the Petitioner has filed a Writ Petition before this Court.

With the abolition of the Letters Patent Appeal, an intra-court appeal cannot be filed. This Writ Petition cannot be entertained by this Court.

In view of the above, this Writ Petition is disposed off. 5.

Needless to state, if the Petitioner desires to avail of a remedy for challenging the judgment of the Learned Single Judge Bench of this Court, the disposal of this Petition would not be an impediment.
