This Petition was heard on the last date of hearing and this Court had granted stay to the impugned order till today. 2.

The learned counsel for the contesting Respondent, on instructions, makes statement that, these Respondents has no objection if the impugned order is set aside, and the Respondent No.3 is directed to decide the proceeding before him under Section 75(5) of the Maharashtra Co-operative Societies Act, N.S. The learned counsel for the Petitioner records no objection for the expeditious disposal of the proceeding in accordance with the law.

In view of the above, impugned order dated 6th August 2024 and show cause notice dated 8th August 2024 issued by Respondent No.3 are hereby set aside. The proceeding before Respondent No.3 are relegated back for decision in accordance with law.

The Authority is directed to decide the said proceeding as expeditiously as possible and in any case within a period of three months from today.
