The learned counsel for the Petitioner submits that, this Court had passed order dated 5th September 2024 indicating that in view of the order passed by the Education Officer there is no reason to pass ex-party order without hearing Respondent. 3.

It is his submission that, in spite of this order, brought to be notice Deputy Director, Kolhapur Division, Kolhapur order came to be passed on 6th September 2024 granting permission to the Management of the Trust to conduct the recruitment process. N.S. Kamble page 1 of 2

501-P1-WP-12728-2024.doc On the face of it, the order passed by the Deputy Director of Education seems to circumvent the order of this Court, hence there would be stay to the recruitment process of RespondentTrust School till returnable date i.e. on 26th September 2024.
