The learned counsel for the petitioner claims to be similarly situated as the petitioner in Writ Petition No.9069 of 2023 (Maitreyai Mahendra Garad Vs. State of Maharashtra through its Department of Medical Education and Drugs & Ors.). While filing in the form for seeking admission, he did not indicate that he was a person with disability-PWD.

According to the petitioner, such option was subsequently indicated by which time the admission process had commenced. The petitioner seeks to rely upon the certificate of disability issued to him on 19/08/2024 by the Ali Yavar Jung National Institute of Speech and Hearing Disabilities (Divyangjan). 1/2

The learned counsel appearing for the respondent no.2 seeks time to verify the same. Time granted. Stand over to 13/09/2024. Since it is informed by the learned counsel for the respondent no.2 that one seat from the PWD quota is lying vacant, the same shall not be filled in until further orders.
