DATE: 26th September, 2024 P.C.:- 1] Pursuant to the order dated 13/09/2024, the petitioner has been examined at the Ali Yavar Jung National Institute of Speech and Hearing Disabilities, Bandra, Mumbai and he has been issued a Certificate of Disability in accordance with Appendix VIII-A dated 20/09/2024. The learned counsel appearing for CET Cell seeks to invite attention to the Notification dated 13/05/2019 amending the Graduate Medical Education Regulations, 2019 to submit that the Certificate of Disability as submitted by the petitioner dated 20/09/2024 cannot be accepted.
2] Prima facie, in our view, the Certificate issued by Ali Yavar Jung National Institute of Speech and Hearing Disabilities, Bandra, Mumbai 1/2
914 wp-12830-24.doc is as per the Appendix VIII-A. The petitioner seeks admission from 85% State Quota and hence it may not be necessary to refer to the Medical Council of India Guidelines referred to by the learned Counsel for the State CET Cell.
3] While permitting the State CET Cell to file an affidavit indicating its stand, the petitioner is permitted to participate in the further round of admission which participation would be subject to further orders in the writ petition.
4] Put up for further consideration on 01/10/2024. Ad-interim relief to continue till that date.
