The learned counsel for the petitioner, on instructions, submits that in Criminal Miscellaneous Application No.2591 of 2023 the possession of the secured asset has been received. He submits that insofar as Criminal Miscellaneous Application No.2632 of 2023 is concerned, the borrower has approached the Debts Recovery Tribunal and interim protection has been granted. 2.
In view of aforesaid, the purpose of filing the writ petition is served. It is open for the petitioner to seek enforcement of the order passed under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act 2002 subject to orders being passed by the Debts Recovery Tribunal. The Writ Petition is disposed of in aforesaid terms.
