The learned counsel for the Petitioners submits that, the Motor Accident Claims Tribunal, Ichalkaranji, DistrictKolhapur has committed error in applying deleted provisions of Section 140 of the Motor Vehicle Act. It is his contention that, w.e.f. 1st April 2022 Section 140 to 144 stood omitted. He further pointed out that, the claim is filed on 3rd October 2022 and as such it was not open for the Tribunal to pass order under Section 140 of the Act. Hence, issue notice to the Respondents, returnable on 23rd October 2024.
