The tribe claim of the petitioner of belonging to Koli-Mahadev - Scheduled Tribe is pending before the Scrutiny Committee. After the report of the Vigilance Cell was supplied to the petitioner, he has been called upon to remain present on 19th September 2024 for consideration of his claim. The petitioner intends to seek admission in the First Year Bachelor of Engineering Course at the respondent no.6 - College. Since the claim of the petitioner is pending and he awaits the Validity Certificate, he approached this Court seeking to protect his admission.

Our attention is invited to the order dated 9th September 2024 in Writ Petition No.12636 of 2024 (Varad Vivek Gaikwad Versus The

Diksha Rane 906 WP 13055-2024.doc State of Maharashtra and Others) wherein it has been observed in paragraph 5 that the issue as to whether the time to furnish the Validity Certificate for candidates of Scheduled Tribe Category would be extended was to be considered by the State Government. On that basis, the time to submit the Caste Validity Certificate was extended till 25th September 2024 subject to further orders. 3.

In view of the fact that the petitioner also claims to belong to the Scheduled Tribe, we are inclined to issue a similar direction by extending the time to submit the Caste Validity Certificate by 25th September 2024 subject to further orders.

It is clarified that such extension will not create equities in favour of the petitioner and it would be consequential upon the adjudication by the Scrutiny Committee.
