The learned Advocate representing Respondent No. 2 has moved a praecipe at 10.30 AM.

The learned Advocate representing Respondent No. 2, submits that the learned Chancellor of the Institute has passed an order dated 22/10/2024, recalling the impugned order dated 14/09/2024 and the further 1/3

order dated 14/09/2024, vide which the Petitioner was allowed to work as the Vice-Chancellor, till 21/09/2024. The photostat copy of the communication dated 22/10/2024, is taken on record and marked as "X" for identification.

The learned Senior Advocate representing the Petitioner submits that all the contentions of the Petitioner, including questioning the authority of the learned Chancellor to conduct an enquiry, be kept open and if an adverse order is passed, considering the interim protection granted by this Court, the effect of the adverse order be extended upto 7 days. He tenders the email address of the Petitioner for service of the order, after it is passed post the enquiry being conducted by the learned Chancellor, as under: "ajit.ranade@gmail.com"

In view of the above, the learned Senior Counsel submits that the Petitioner may be permitted to withdraw this Petition by keeping all contentions open with 7 days protection, if an adverse order is passed against him. He further prays that the order should be communicated to the Petitioner on the date of its passing, via email. 5.

The learned Advocate representing Respondent No 2, submits that 2/3

the protection granted by this Court should not be extended any further. 6.

In view of the above, this Writ Petition is disposed off, as withdrawn, on instructions, in the light of the document 'X'. All contentions are kept open.

If any adverse order is passed against the Petitioner, the same shall contain reasons, shall be served on the Petitioner forthwith by email and the said order would take effect 7 days post service, considering that the Petitioner has been protected by the interim order of this Court, for quite some time.

The pending Interim Applications would not survive and stand disposed off.
