By the present Writ Petition filed under Article 227 of the Constitution of India, the challenge is to the legality and validity of the Order dated 11th July 2024 passed by the learned Judge, Family Court No.2, Pune, below Exhibit-12 in Petition No. A-1757 of 2022. 2.
Mr. Bhoite, learned Counsel for the Respondent tenders a photocopy of the Roznama of Petition No. A-1757 of 2022. The said Roznama is taken on record and marked "X" for identification. He points out Roznama dated 6th November 2025. The said Roznama dated 6th November 2025 read as under :- "called on today both parties are absent advocate for both parties are present 43-application by respondent advocate to dismiss petition-

Thus, it is clear that the main Petition has been dismissed. The Order challenged in this Petition is the interim Order. Thus, nothing survives in the Writ Petition and therefore the same is disposed as infructuous.

However, liberty is granted to the Petitioner to file a fresh Petition, in case the said Petition No. A-1757 of 2022 is restored to the file of the learned Family Court, Pune.
