Mudassir Mirkhan Mohammad Quadirkhan And Another ...
Mr. Shaikh Hakkani M Hussain, Advocate for the Petitioners Mr. I. D. Maniyar, Advocate for Respondent no.1 .....
CORAM : AJIT B. KADETHANKAR, J.
DATED : 06TH APRIL, 2026 ORDER :- .
Feeling aggrieved by the order dated 04.07.2024, passed by the learned Joint Charity Commissioner, Chhatrapati Sambhajinagar on an application below Exhibit 3 in Appeal No.16 of 2024, the petitioners have filed present petition. Apparently, the order is an interim order. The Writ Petition is filed in 2024. Since then, there is not preventive order passed by this Court against any authority. 2.
Mr. Shaikh Hakkani M Hussain, learned Counsel for the petitioners would submit that the main petition is pending before the learned Joint Charity Commissioner since long. He would submit that due to pendency of this Writ Petition, the proceedings before the learned Joint Charity Commissioner, Chhatrapati Sambhajinagar have not progressed. Reserving his right against the order impugned in this Writ Petition he makes a fair statement that the petition be disposed of with
57-wp-13145-2024 directions to the learned Joint Charity Commissioner to conclude the main proceedings in appeal No.16 of 2024 within a time bound manner.
3.
Mr. I. D. Maniyar, learned Counsel for the respondent no.1 has no objection to such submission.
4.
In view of this, the Writ Petition stands disposed of with a request to the learned Joint Charity Commissioner, Chhatrapati Sambhajinagar to conclude the main proceedings in appeal No.16 of 2024 as expeditiously as possible, preferably within three months from today and in any case within six months from today.
5.
Mr. I. D. Maniyar, learned Counsel for the respondent undertakes not to take any unjustifiable adjournment in the proceedings.
6.
Parties undertake to assist the learned Joint Charity Commissioner for early disposal. All contentions kept open. 7.
Petitioners as also respondents shall not take any steps which will protract or delay the hearing in the appeal no.16 of 2024.
