ORDER :

Learned Advocate on behalf of the State Human Rights Commission has entered appearance and has tendered an affidavit dated January 23, 2026. The same is taken on record. 2.
It is stated in the affidavit tendered, that suo motu cognisance by the State Human Rights Commission of the matters involved, had been taken in December 2023, while the Suit referred to in the Petition in question has been filed only in January 2024. Be that as it may, her instructions are to submit that since the matter is now sub judice, the Commission does not intend to persist with the proceedings commenced on a suo motu basis.

In this view of the matter, nothing survives in this Petition. The Petition is disposed of as infructuous.

Learned Senior Advocate on behalf of the Petitioner clarifies that after the suo motu cognisance was taken by the State Human Rights Commission, Municipal Authorities had issued a notice towards the end of December 2023, which led to the Suit being filed in January 2024, and protective reliefs were granted in January 2024.

The submission of the Commission that the suo motu case opened by the Commission is not be persisted with, is recorded as a statement made on instructions. Consequently, this Petition is rendered infructuous and disposed of accordingly. 6.
All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
