The learned counsel for the Petitioner submits that, the Collector has accepted the explanation submitted by the Petitioner with regard to the monthly meeting. However, finally he was disqualified for not convening monthly meetings of January, February and March 2023.

The learned counsel for the Petitioner has drawn attention to this Court to the provisions of Section 7 and 36 of which contemplates that, non convening of the meeting by itself N.S. Kamble page 1 of 2

15-WP-13290-2024.doc would not attract disqualification, but only if the same is not satisfactorily explained. In the instance case prima facie perusal of the impugned order indicate that, the Collector has accepted explanation provided by the Petitioner, however proceeded to disqualifying him. Hence, arguable case is made out by Petitioner. Hence, issue notice to the Respondents, returnable on 24th October 2024.
