The proposal for approval of the Petitioner's appointment as Junior Clerk was rejected by the impugned order dated 20th April 2023, by the Education Officer (Secondary), Zilla Parishad, Sindhudurg. 2.

In our opinion, adequate opportunity ought to have been given to the Petitioners to rectify the deficiencies mentioned in the proposal. Such opportunity appears not to have been given.

In this view of the matter, we are of the view that the impugned Shubham Talle 1 of

31-WP-13376-2024.doc order dated 20th April, 2023 can be treated as show cause notice to the Petitioners. Petitioners to file response to the said show cause notice dated 20th April, 2023 within a period of two weeks from today. Within a period of four weeks thereafter the Education Officer (Secondary) to decide the said proposal after taking into consideration the response of the Management. In case the proposal is approved, the Deputy Director of Education to grant Shalarth ID to the Petitioner. 4.

Writ Petition stands disposed of.
