This Petition seeks to quash and set aside the Judgment and Order dated March 21, 2024 passed by the Learned Presiding Officer, School Tribunal, Nashik in Appeal No. 25 of 2021 and the Appeal filed by the Petitioner be allowed. It also seeks to quash and set aside the termination letter dated February 15, 2018, thereby reinstating the appellant with continuity of service and full back wages. 2.

On the last occasion, Learned Advocates for the parties had indicated that the underlying grievances could be worked out constructively without the need for this Petition to be adjudicated. They Digitally signed by AARTI GAJANAN PALKAR Date:

were requested to engage with their respective clients and come up with agreed terms on which the matter could be disposed of. 3.

Today, when the matter is called out, Learned Advocates for the parties signify that consensus has been reached to resolve the grievances in the following terms :- A] The Petitioner shall be reinstated to the post of Lab Attendant with effect from October 1, 2009 in Respondent No.2 school with service continuity in all respects except for back wages;

B] As of now, the Petitioner shall be absorbed as a Lab Assistant in Nutan Madhyamik Vidyalaya, Bhatgaon, Tal. Chandwad, Dist. Nashik with effect from the date of this order being uploaded on the Court's website;

C] The Petitioner confirms that back wages from October 1, 2009 until such date of absorption back as a Lab Assistant are being positively waived;

D] With the aforesaid arrangements, Respondent No.4 Education Officer shall process the file and grant approval for the aforesaid resolution in accordance with law, so that the Petitioner's appointment as a Lab Assistant from today with service continuity benefits and other benefits subject to the waiver of back wages, can be implemented without any further hindrance.

With the aforesaid arrangements, this Petition is hereby finally disposed of.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
