PATIL, JJ DATE : 27th SEPTEMBER, 2024 P.C. :- The challenge raised in the present writ petition is to the tender notice dated 20th September 2024 that has been issued by the Home Department of the State Government in the matter of supply of canteen items at various prisons in the State. 2.
Learned counsel for the petitioner by referring Clause 4.4.3
2/3 of the Revised Manual of Office Procedures for Procurement by the Government of Maharashtra dated 1st December 2016 submits that since the value of the tender was beyond Rs.5 crores, the minimum duration of tendering ought to have been three weeks or 15 working days whichever is higher. According to him, the tender notice in question published on 20th September 2024 grants a tendering period of only seven days. 3.
On hearing the learned counsel for the petitioner, we do not find any averment made in the writ petition that because of the short tendering period, the petitioner was unable to participate in the tender process. The only grounds raised in the writ petition are that the curtailment of the period of submission of bids is mala fide and in contravention of the policy dated 1st December 2016. To support the allegations of mala fide, there are no specific pleadings.

The learned Additional Government Pleader submits that a challenge to the same tender notice was turned down yesterday
3/3 by the Aurangabad Bench.

We do not find any exceptional case is made out to interfere in exercise of writ jurisdiction especially when today is the last day for submission of bids.

The Writ Petition is therefore dismissed with no order as to costs.
