IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 13471 OF 2024 Varsha Shivnath Khedkar
VERSUS
The State Of Maharashtra Through Its Secretary And Others ...
Advocate for the Petitioner : Mr. K.D. Pote h/f Mr. Arvind Gopalrao Ambetkar AGP for Respondent/State : Mr. P.S. Patil Advocate for Respondent Nos.7 & 8 : Mr. S.B. Pulkundwar ...
CORAM : S.G. MEHARE AND SHAILESH P. BRAHME, JJ.
DATED : DECEMBER 10, 2024 PER COURT:- 1.
Heard learned counsel for the petitioner.
2.
The petitioner is seeking inter-district transfer and requesting the authorities since long. The representations were rejected on the same ground that the vacancies to the category which she is belonging are not available with the Zilla Parishad, Ahmednagar. The last order is also the same. The petitioner has contended that the respondents are allowing the transfer to other candidates and considering the petitioner.
3.
The impugned order reveals that other transfers were done because there were mutual consents. The tone of the petitioner is that the officers/respondents are deliberately not accommodating her under the couple convenience policy.
946-wp-13471-2024.odt (2) 4.
We have gone through the impugned orders. Those reveals that since the post to which the petitioner belongs are not vacant. Hence, she could not be accommodated. 5.
Learned counsel for the petitioner seeks time to verify from the petitioner whether such identical orders have been passed. 6.
Since we are not satisfied with the submissions of the petitioner, we expressed our opinion that if the petitioner would not satisfy the Court that she is legally entitled to seek the inter-district transfer and the petitioner would not be able to satisfy that there was a deliberate discrimination, the Court would impose a heavy cost. 7.
Stand over to 07.01.2025.
