In this writ petition, the petitioner seeks a direction to respondent no. 1 to disclose the information with regard to the loan availed by respondent no. 5.

It is the case of the petitioner that he is owner of the property in question which was let out to respondent no. 5 on leave and licence basis. However, the respondent no. 5 has taken a loan from respondent no. 1 and has defaulted in payment of the loan amount. The petitioner, thereupon requested the Thane Municipal Corporation on 22nd July 2024 to provide details of the loan. However, the Municipal Corporation refused to supply the information by a communication dated 29th July 2024.

The Court had issued notice on 3rd October 2024. Office note indicates that the respondent no. 1 has been served, whereas the notice issued to respondent no. 5 has been received back with an endorsement that the said respondent has expired.

In view of the aforesaid, learned counsel for the petitioner prays for an adjournment in order to enable him to make an application seeking substitution of the legal heirs of the deceased respondent.
