CIVIL APPELLATE JURISDICTION WRIT PETITION NO.13489 OF 2024 Bismillah Abbas Khan ....Petitioner

Versus

The State Of Maharashtra & Ors.

....Respondents Mr. Fakhruddin Khan a/w. Saima Ansari, for Petitioner. Ms. Uma Palsuledesai, for Respondent No.4-SRA. Dr. Dhruti M. Kapadia, AGP for State.

CORAM: SOMASEKHAR SUNDARESAN, J.

DATE : JANUARY 28, 2026 ORDER :

1.

Learned Counsel for the Petitioner restricts his prayer to a direction to the electricity supplier, Adani Electricity Mumbai Limited ("Adani Electricity") to have the Petitioner's electricity connection verified and certified. He draws the Court's attention to a letter dated March 18, 2019, by which Adani Electricity refused to certify his electricity connection on the ground that a specific direction from a statutory authority with jurisdiction had not been received. The said Digitally signed by ASHWINI JANARDAN VALLAKATI Date:

2026.02.16 16:39:34 +0530 ASHWINI JANARDAN VALLAKATI letter is found at Page No.81 of the Petition.

2.

Since it is a case of the Petitioner that the verification of the electricity connection being Account No.150733929 brings him within the eligibility of a Government Resolution dated May 16, 2015, it would be important to enable the Petitioner to have his electricity connection verified and certified by the service provider. 3.

A direction is therefore being issued to Adani Electricity, which is a distributor of electricity under a license issued by the Maharashtra Electricity Regulatory Commission, to verify the electricity connection and certify the factual position of the Petitioner, so that he may be able to demonstrate his claim for entitlements before authorities implementing the Slum Rehabilitation Project. 4.

Adani Electricity is directed to provide such verification and certification within a period of two weeks from being approached with a copy of this order. The same shall be provided to the Petitioner as well as to the Respondent.

5.

Once the Respondents are provided with a verification by Adani Electricity, it would be open to the Petitioner to make submissions to the Respondents on how the verification would need them to change the approach adopted in the impugned order. Let such application be made within a period of two weeks from the provision of verification by Adani Electricity. The Respondents shall deal with such application

within a period of four weeks from the receipt of the report from Adani Electricity.

6.

With the aforesaid directions, the Petition is finally disposed of. 7.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
