The petitioner had approached the New Mumbai Municipal Corporation for taking action against illegal building of Airoli Neha Cooperative Housing Society Ltd. which is located on Plot NO.7, Sector No.20-C, Airoli, Navi Mumbai admeasuring 1199.988 sq. mtrs. The reasons why the structure in question is illegal, according to the petitioner has been spelt out in the legal notice dated 12th August, 2024, which is at page 44 of the paper-book. The Corporation has neither replied to the notice nor has it looked into the allegations made. 2.

If it is found that the said structure is illegal and unauthorised, the Corporation must act and proceed to take action against such structure in Amk 1/2

In such view of the matter, this petition can be disposed of by directing the respondent-Corporation to look into the legal notice dated 12th August, 2024, which is at page 44 of the paper-book and to also go through the averments made in this writ petition and take appropriate action in accordance with law. If the competent authority is of the opinion that the action needs to be taken, it would be open for the competent authority of the respondent-Corporation to issue notice to the Airoli Neha Co-operative Housing Society Ltd. and after hearing them and following due process, pass appropriate orders and take necessary action in accordance with law. Let this exercise be completed within a period of six months from the date of communication of this order. 3.

The petition is disposed of.
