The writ petition arises out of refusal of membership by the society to the respondent No.3. The Authorities under the Act directed society to grant membership. The Society challenged the order on the ground that the respondent No.3 intends to use the plot in question for the purpose which is not permissible. 2.

However, during the pendency of the present writ petition, respondent No.3 has filed undertaking stating that the respondent No3 shall not change use of the plot in question for any other purpose than residence without permission of the society. The undertaking is filed with the society.

In that view of the matter, the society does not press the writ petition. The writ petition, therefore, stands disposed of. 4.

No costs.
