The officers from Water Resources Department, Government of Maharashtra are present. Due to election work, they could not give instructions to learned AGP for filing an additional affidavit. Court can understand it.

The learned Advocate for Respondent Nos.1 and 2 submitted that they have stopped the work of erection of pipeline which they

LSP 2 1 wp 13657.24.doc have undertaken as per the agreement executed with Water Resource Department and they have completed it upto 60%. The learned Advocate for the petitioner-plaintiff submitted that let there be order not to take up the water.

In view of that today it is made clear that the Respondent Nos.1 and 2 may carry out the remaining work but they will not actually fetch the water until further orders. It is made clear that they will not claim any equities.

Even though there is an agreement in between Water Resources Department and Respondent Nos.1 and 2, the learned AGP wants to file additional affidavit. In view of that, let this matter be placed on 2 December 2024, First on Board. 5.
