1) Petitioner is having substantive remedy to prefer an Appeal before the Collector, District Sangli, under Section 257 of the Maharashtra Land Revenue Code and without availing the said alternate remedy, present Petition is filed under Article 226 of the Constitution of India. 2) Facing with the said difficulty, Mr. Sathe, learned Advocate appointed by Legal Aid Committee to represent the Petitioner, on instructions from the Petitioner, who is personally present in the Court, seeks leave to withdraw the Petition with liberty to file an Appeal before the Collector, District Sangli.
2.1) Leave and liberty granted.
3) Disposed off as withdrawn with aforesaid liberty. 1/2
RVC 31 Wp-13786-2024.doc 4) In case the Petitioner files such an Appeal before the Collector, Sangli, the said Appeal will be subject to the provisions of law of limitation. 5) If the Petitioner files such an Appeal, we request the Collector of District Sangli to make an endeavor to dispose off the same within a period of six months from the date of its filing.
