The challenge in this Petition is to an order dated 27th June 2024 passed by the learned Civil Judge, Senior Division, Thane, whereby an application preferred by the petitioner-plaintiff to examine Advocate Abhijit Natu who had addressed the letters dated 21st August 2006 (Exhibit "80") and 26th September 2006 (Exhibit "81")on behalf of ARUN RAMCHANDRA SANKPAL defendant no.1 to the Advocate for the plaintiff, came to be rejected. The learned Civil Judge was of the view that, since the documents are already marked in evidence, it was not necessary to examine the said witness.

I have perused further examination-in-chief of the witness (Exhibit "M" colly). The documents (Exhibits "80" and "81") are marked in evidence by the learned Civil Judge without any qualification, like subject to proof and correctness of the contents. 5.

In this view of the matter, since the documents have been marked in evidence and can be legitimately read in evidence, the impugned order passed by the learned Civil Judge does not merit any interference. 6.

Petitions stands disposed.
