It has been argued by the learned counsel for the petitioner that respondent No.1, while joining on the post of Principal Secretary at Central Institute for Research on Cotton Technology, Mumbai, did not disclose that he was already drawing pension on account of his earlier employment. The submission is, thus, that the aforesaid aspect of the matter has clearly been ignored by the Tribunal.

Thus, having regard to the aforesaid and other relevant aspects of the matter, we provide that till the next date of listing the impugned judgment and order dated 18th April
