Mentioned out of turn by the learned Advocate for the petitioner. Learned counsel for the petitioner on instructions of the petitioner submits that the petitioner is ready to amicably settle the dispute. She submits that considering his income and his responsibility towards his old parents he is unable to pay an amount of Rs.6000/- per month to the respondent. She further submits that to show his bonafide the petitioner shall pay entire arrears which according to the petitioner is to the tune of Rs.60,000/- to the respondent within four weeks from today. Statement made on behalf of the petitioner is accepted as an undertaking to this court.

After payment is made, learned Advocate for the petitioner shall place on record receipt of payment. On submitting receipt of payment office is directed to issue notice to respondent returnable on 3rd January 2025.

Learned Advocate for the petitioner shall in addition to court notice serve the respondent by private notice alongwith copy of this order and file service affidavit before the next date. 4.

The aforesaid amount of arrears to be directly paid to the respondent by transferring it to her bank account. 5.

Subject to compliance of the aforesaid payment, no coercive action to be taken against the petitioner for recovering the arrears as per the impugned order.
