The learned Advocate for the Petitioner and the learned AGP are ad-idem on the fact that the Petitioner's appointment was approved with a specific order of approval. The matter is now pending with the Respondent No. 2 for grant of Shalarth I/D. The Petitioner is a compassionate appointee and is covered by the law laid down by this Court in Yogita Shivsing Nikam v/s. The State of Maharashtra & Ors.1 2.
In view of the above, this Writ Petition is disposed off with a direction to Respondent No. 2 to allot the Shalarth I/D to the Petitioner, AIRONLINE 2021 BOM 3071 Talwalkar
946.WP14145.2024.odt within 15 days from today. Thereafter, the Management would submit a bill of arrears of salary, if any, with reference to the unpaid salary of the Petitioner and the Education Department shall carry out the verification exercise for calculating the arrears and ensure that the same are paid within 45 days from the date of submissions of the bills. Needless to state, the regular payment of the Petitioner shall commence on allotment of the Shalarth I/D.
