The grievance raised by the petitioners is that without complying with the requirements of Rules 8 and 9 of the Security Interest (Enforcement) Rules, 2002, the property owned by the petitioner no.1 has been auctioned. The petitioner no.1 has preferred Securitization Application No.525 of 2023 before the Debts Recovery Tribunal, which is pending. Since the said proceedings are not being further considered, the petitioner no.1 has approached this Court.

In the light of the fact that the petitioner no.1's Securitization Application bearing No.525 of 2023 is pending before the Debts Recovery Tribunal, liberty is granted to move an application before it for expeditious 1/2 9-WP-14170-2024.doc Dixit

consideration of the said proceedings. If such application is moved, the Debts Recovery Tribunal shall consider the same in accordance with law and pass orders thereon.
