During pendency of the suit, an application for temporary injunction was rejected. That is why Plaintiff has preferred Misc. Civil Appeal. During the pendency, defendant filed an application as per the provision of Order XXXXI Rule 27 of the Civil Procedure Code. It was allowed. It is challenged by way of this writ petition by the Plaintiff. The hearing of the appeal is stayed.
