The learned advocate for the petitioner submits, on instructions, that considering the decision of the Deputy Registrar of the Trade Unions, Konkan Division, Mumbai, dated 10th November, 2023 and the impugned communication dated 28th February, 2024, the Petitioner Union desires to approach the Pallavi Wargaonkar, PS [Note: This order is corrected vide speaking to minutes of order dated 16.01.2025.]
.. 2 .. 970-WP-14183-2024 spk to min Industrial Court by preferring ULP proceedings for alleging unfair labour practices against MSRTC, inter-alia, on the ground of failure to implement the settlement, agreement or Award, under Item 9 of Schedule IV of the Maharashtra Recognition of Trade Unions And Prevention Of Unfair Labour Practices Act, 1971.

In view of the above, this Writ Petition is disposed off. If the Petitioner approaches the Industrial Court within 03 weeks from today, the time spent by the Petitioner in this Court from 27th March, 2023, till passing of this order, would be a good ground for condonation of delay. So also, liberty to raise the ground of recurring cause of action.
