The Petitioner contends that as she has scored 107 marks, she is already in the select list in the general category. Being a sports
Trupti 2 971-wp-14185-2024.odt person, had her sport certificate not been invalidated by Respondent No.2 without granting an opportunity of hearing, she would have been considered from the sports quota. Since she had applied from the sports category, invalidation of the said certificate leads to disqualification of the Petitioner.

The learned Advocate for the Petitioner, on instructions, makes a solemn statement that the Petitioner has already been selected by the Zilla Parishad, Buldhana. The cutoff marks for the Zilla Parishad, Buldhana is 104. We, therefore, direct that if any candidate having scored marks lesser than the Petitioner and appointed in the Zilla Parishad, Buldhana, or any such ZP, such appointment shall not create any equities in favour of the newly appointed candidate and would be subject to the result of this Petition.
