Perusal of the Written Statement filed by the Petitioner would indicate that though engagement of the Respondent in the year 2006 on daily wages is admitted, the Petitioner took a specific stand that the Respondent did not complete 240 days of service prior to the year 2006. The Petitioner further contended that Respondent was later recruited through the Contractors Swapnil Enterprises and Power India Private Limited. Petitioner further took a stand that termination of the Respondent was by the said contractors and not by the Petitioner. However the contractors were not impleaded as party Respondents to the Complaint. 5.
