Heard the learned Counsel for the parties.

The genesis of the dispute in RCS No.6 of 2015 and SCS No.332 of 2024 is the same. Identical questions of facts and law may arise for determination in both the suits. Thus, to avoid duplication of efforts on the part of the parties as well as the Courts in trying the aforesaid two suits separately, it would be expedient in the interest of justice that both the suits are heard and decided by one and the same Court, simultaneously. 3.

Therefore, with the consent of the learned Counsel for the parties, the impugned order 18 September 2024 stands quashed and set aside. 4.

RCS No.6 of 2015, pending on the file of the learned Civil Judge, Jr. Division, Uran, stands transferred to the Court of Civil Judge, Sr. Division, SSP 1/2

29 wp 14329 of 2024.doc Panvel, who is seized with SCS No.332 of 2024, for hearing and disposal in accordance with law.

Learned Civil Judge, Jr. Division, Uran, is directed to transmit the record and proceedings in RCS No.6 of 2015 with such despatch that it reaches the Court of Civil Judge, Sr. Division, Panvel within a period of four weeks from today.

The parties shall appear before the Court of Civil Judge, Sr. Division, Panvel on 15 December 2025.
