1) Mr. Aradhye, learned counsel appearing for Respondent No.3, made a grievance that, as the Respondent No.8, did not co-operate in the measurement and survey of the concerned land, the process of acquiring the said piece of land and construction of the road thereof could not be completed.

2) Mr. Kadam, learned senior counsel appearing for Respondent No.8, on instructions, makes a statement that, the Respondent No.8, will cooperate in measuring and surveying the piece of land owned by him. He 1/2

dtg 39-Wp-14341-2024.doc submitted that, the only expectation of the Respondent No.8 is that, the Planning Authority/Acquiring Body must comply with the statements made by the Respondent No.3 and recorded in Order dated 28th September 2021, passed in WP No. 3769 of 2021 i.e. to pay the Respondent No.8 necessary compensation as per the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. 3) Mr. Aradhye, learned counsel for Respondent No.3, seeks time to take instructions.
