On perusal of the impugned order, it appears that the question of law involved in the present petition is similar to the group of petitions considered by this Court in Writ Petition No. 10750 of 2022 along with connected matters, decided on 17th October 2025. Accordingly, the present petition deserves to be disposed of in terms of paragraphs 144 to 148 of the said judgment.

However, it is clarified that while adjudicating the matter, the Authority shall duly take into consideration the reasons and observations recorded in the aforesaid judgment.

The Authority shall, therefore, consider the factors referred to by this Court in the said judgment and thereafter proceed to adjudicate the issues in accordance with law. The writ petition stands disposed of in terms of paragraphs 144 to 148 of the judgment rendered in Writ Petition No. 10750 of 2022 with connected matters.

The Authority shall also adjudicate the issue as to whether the legal representatives of the original delinquent can be held liable under Section 88 of the Maharashtra Cooperative Societies Act, 1960.
