Mr. Kulkarni, the learned counsel appearing for the Petitioner seeks leave to withdraw the Petition with liberty to file a fresh application under provisions of section 28(1-A) of the Trade Unions Act, 1926. Since Application (ICTU) No.8 of 2022 filed at the instance of the Union has been held to be not maintainable. Mr. Kulkarni would further clarify that the term of office bearers of the Union would otherwise come to an end on 26 October 2024. 2.

The Petitioner is permitted to withdraw the Petition with liberty to file a fresh application under section 28(1-A) of the Trade katkam Page No.

It is however clarified that filing of such consent shall not come in the way of holding of fresh elections of the Union after 26 October 2024 in accordance with law.

To enable the individual member(s) to file a fresh application under section 28(1-A) of the Trade Unions Act, the interim order granted earlier by the Industrial Court on 10 February 2023 shall continue to operate for a period of two weeks from today.
