Preliminary objection has been taken by the learned counsel appearing for the Respondent that under Section 20 of the Goa, Daman and Diu Registration of Tourist Trade Act, 1982, an appeal is maintainable against the order passed under Section 10 of the said Act. 2.
Learned counsel appearing for the petitioner submits that as the provisions are violated, the petition has been filed directly before this Court.

Considering that the alternate remedy of an appeal is available to the petitioner, I am not inclined to consider the petition and exercise the power under Article 227 of the Constitution of India. The petition is disposed of with liberty to petitioner to avail the alternate remedy. Sairaj 1 of

Needless to clarify that this Court has not gone into the merits of the matter and as such all the rights and contentions of the parties are expressly kept open.
