Application of the petitioner seeking prior sanction under Section 36A of the Maharashtra Land Revenue Code, 1966 has been rejected by the Collector on the ground that appropriate Authority is the State Government.

Mr.Damle, learned Senior Advocate appearing for the Petitioner would submit that application under Section 36A has to be routed to the State Government through the office of the Collector and in the present case, instead of adopting that course, the Collector has rejected the application.

Learned AGP seeks time to take instructions. Issue notice to the respondents returnable on 6th December 2024. Learned AGP waives service of notice for Respondent Nos.1 and 2. 5.
In addition to Court notice, petitioners to serve the respondents by private notice and file affidavit of service before the next date. 6.
Liberty to file additional affidavit before the next date. 7.
