The issue which has been raised at this stage is the jurisdiction of the Tribunal to entertain the appeal in view of the fact that on 17th February, 2020, the certificate of permanent affiliation has been granted to the Petitioner by which the Petitioner was permanently affiliated with Dr. Babasaheb Ambedkar Technological University and therefore, the Tribunal which exercised jurisdiction qua the Pune University, Shivaji University and Solapur University cease to have jurisdiction.

The argument as regards Respondent No.1 is that unless the last batch of the student is cleared, there is a transitory period which will Sairaj 1 of

32 Wp-14936-2024.doc vest the power in the University by placing reliance under Sections 80, 81 and 110(5) of the Maharashtra Public Universities Act, 2016. 3.
